Insurance pitfalls
Continuous monitoring allows our team to mitigate the risks of a client flying on an aircraft without adequate liability coverage, below recommended global minimums or much worse, without any insurance coverage. Let us delve a bit deeper into these areas:

Inadequate Aircraft Liability Insurance
Private aircraft charter is an industry which facilitates the travel of high net worth, celebrity and VIP passengers. These individuals can be accustomed to and/or sometimes obligated to engage higher levels of safety and coverage. This is an area of exposure which needs to be evaluated and requires a private jet provider who is willing to reciprocate transparency and trust whilst communicating on the needs of the Charterer. Inadequate insurance coverage can jeopardize the lives of families and dependents should their be an incident.
Recommended Global Minimums
The framework of the International Civil Aviation Organization (ICAO) Montreal Convention of 1999 was created to address the harmonization of passenger liability coverage in the global aviation industry. However, with 32% of ICAO jurisdictions (as of 2022) yet to sign this treatise, the patchwork of varying liability regimes continues to exist around the world and some aircraft operators utilize this freedom by taking coverage that matches their own comfort level. Therefore, evaluation of insurance coverage to assess if passenger liability amounts meet or surpass the recommended global minimums remains ever pertinent in order to communicate this potential exposure for passengers travelling on a private aircraft charter.


Loss of Insurance Coverage
We are not aware of any jurisdiction that allows an aircraft operator to engage in private jet charter services without having passenger liability insurance. However, we are aware of aviation insurance policies that allow for premiums to be paid in installments by specific dates and these policies do make a provision for a termination of insurance coverage should there be a missed payment. Therefore, receiving an updated insurance certificate after an installment date becomes critical so as to verify that the passenger liability insurance remains current.
Unwilling to Compromise Your Flight
Is it right to assume an operator’s comfort level for passenger liability coverage will match the recommended minimum or your own requirements? We do not think so and this is one of the areas we can discuss when proposing a customized aircraft charter solution to you.
Whist our discussion to this point has touched on the potential pitfall of flying on an aircraft with no coverage due to a breach of payment terms, there are other potential breaches of aircraft liability insurance that are worth mentioning as we look to conclude our insights on Private Aircraft Charter Insurance:
Operations into specific geographical locations: Many policies have worldwide coverage, with restrictions for specific locations where you cannot operate the aircraft or fly-over with the aircraft. Such locations can include Venezuela, Cuba or North Africa.
Illegal use: An entity that has not obtained an air operator certificate from their regulatory authority cannot charter the aircraft to others or fly for hire/compensation. A private aircraft and a private aircraft approved for commercial operations are completely different in the eyes of the prevailing Civil Aviation Authority as well as to the Insurance underwriters.
Landing and Take Off from sites not in accordance with regulations: Unsafe operations can also qualify as an exclusion and void insurance coverage. Runway lengths, accelerate-stop distances and landing distance factors are items to be considered.
Unapproved use: There may be limitations to approved operations which may create insurance exposure on your next private aircraft charter, this is also an area worth considering.
